Theft Charges & Penalties in Indiana

Theft can include criminal activity that ranges from shoplifting to stealing millions of dollars. The crime of theft may be a misdemeanor or felony, depending on what was stolen and the market value of the allegedly stolen items.

When the value is under $750, theft is charged as a Class A misdemeanor, punishable by a maximum jail sentence of 1 year and a fine of up to $5,000.

If a person steals property worth between $750 but less than $50,000, a firearm, a motor vehicle or its parts, or commits a second of subsequent theft offense, it is considered a level 6 felony, which carries a prison term of up to 2 ½ years and a maximum fine of $10,000.

If a person steals property worth $50,000 or more, commits a second or subsequent offense for stealing a motor vehicle or its parts, or steals valuable metal that creates a significant risk of injury to others, it is a level 5 felony, which can result in imprisonment for up to 6 years and a fine not exceeding $10,000.
